Die mislukte aanslag is nie die einde nie

OSV en mislukte aanslag op die grondwet is nie die einde nie. 
- Waak teen oorgerustheid 

Die Afrikanerbond het kennis geneem van die ANC se mislukte aanslag op die grondwet en die poging om die vereiste tweederde meerderheid te kry om die 18de grondwetlike wysigingswetsontwerp deur te voer wat onteiening sonder vergoeding moontlik sou maak. 

Hierdie is hoogstens slegs ‘n tydelike oorwinning vir die demokrasie aangesien die ANC reeds sedert 2008 poog om onteiening in verskuilde vorms deur te voer. Ons moet dus waak teen ‘n valse gerusstelling aangesien die ANC se beleid en besluite nie op rasionele gronde berus nie, maar eerder gebaseer is op faksie twiste en politieke oorlewing. Dit is duidelik ook uit die ANC se bydraes in die debat voor die stemming dat die ongrondwetlikheid en die drakoniese aard van onteiening nie deurgedring het tot die ANC of sy alliansie-vennote nie.  

Die Afrikanerbond, as fasiliteerder van die Ad Hoc Groep vir die Beskerming van Eiendomsregte, sal voortgaan om beleidsraamwerke wat ongrondwetlik is teen te staan en waar nodig burgerlike steun help mobiliseer. In die verband moet die rol van die burgerlike samelewing nie onderskat word en met die steun van verskeie politieke partye kon die wysigingswetsontwerp, wat deur ʼn ondeurdagte proses gestoomroller is, gestuit word.   

Die Afrikanerbond wil by herhaling pleit dat hierdie ondeurdagte en onnodige fokus op die onteiening van grond anders hanteer word. Dit is krities noodsaaklik dat enige proses billik en regverdig, nie-verdelend, doeltreffend, ekonomies aanvaarbaar, vinnig en landboukundig volhoubaar sal wees.

ʼn Oorhaastige konferensiebesluit van die ANC het gelei tot ontsaglike vermorsing van die staat se reeds beperkte hulpbronne. Die foute moet veel eerder gesoek word by amptenare en departemente wat strompel van die een mislukking na die ander. Daarom word onteiening en grondwetwysigings bevorder ten koste van ordelike en internasionale norme en standaarde. Dit is lankal reeds duidelik dat die ANC met sy rug teen die muur staan wat grondhervorming en ander beleidsaspekte aanbetref. Dekades se wanbestuur, mislukkings, korrupsie, beleidsomkerings, ideologiese verwarring en verwerping van enige goedbedoelde advies en duidelike en bewese grondvoorstelle het die ANC in ʼn posisie geplaas waaruit hy nie meer kan ontsnap nie. Die enigste ontsnaproete was om ʼn moontlike konstitusionele krisis te skep deur wysigings aan die Grondwet aan te bring. 

Daar moet by niemand enige twyfel wees dat die ANC nie te vinde is vir enige oplossing binne die grondwetlike raamwerk nie, en na gister se vernedering met meer irrasionele aggressie gaan optree. Ons moet Hoop hê om onvermoeid te werk aan 'n oplossing vir die huidige grondkwessie, maar om Hoop te hê verg ook 'n positiewe ingesteldheid! Daarom gee die Afrikanerbond deurgaans steun en ondersteuning vir enige inisiatief wat eiendomsreg in Suid-Afrika vestig. Baie voorstelle vanuit die burgerlike samelewing is reeds in die verlede gemaak om op kreatiewe wyses ʼn oplossing te vind.

EWC and failed onslaught on the constitution are not at an end. 
- Guard against overconfidence 

The Afrikanerbond took note of the ANC's failed attack on the constitution and their attempt to get the required two-thirds majority to implement the 18th constitutional amendment bill, which would allow for expropriation without compensation. 

This is at most only a temporary victory for democracy, as the ANC has been trying since 2008 to carry out expropriation in hidden forms. We must therefore guard against a false assurance: the ANC's policies and decisions are not based on rational grounds, but rather on factional disputes and political survival. It is also clear from the ANC's contributions to the debate before the vote that the unconstitutionality and draconian nature of expropriation has not got through to the ANC or its alliance partners.  

The Afrikanerbond, as facilitator of the Ad Hoc Group for the Protection of Property Rights, will continue to oppose policy frameworks that are unconstitutional and will, where necessary, help mobilise civilian support. In this regard, the role of civil society should not be underestimated and with the support of various political parties, the amendment bill, which was steamrollered through an ill-considered process, could be stopped.   

The Afrikanerbond has repeatedly pleaded that this ill-considered and unnecessary focus on the expropriation of land be handled differently. It is critically essential that any process be fair and equitable, non-distributive, efficient, economically acceptable, rapid and agriculturally sustainable.

An overhasty conference decision of the ANC has led to enormous wastage of the state's already limited resources. The fault should much rather be sought in the actions of officials and departments who stumble from one failure to another. Therefore, expropriation and constitutional amendments are promoted at the expense of orderly and internationally accepted norms and standards. It has long been clear that the ANC is standing with its back to the wall when it comes to land reform and other policy aspects. Decades of mismanagement, failures, corruption, policy reversals and ideological confusion as well as the outright rejection of any well-intentioned advice and clear and proven land proposals have put the ANC in a position from which it can no longer escape. The ANC has created its own crisis around property rights, and the only escape route is to create a potential constitutional crisis by making ill-considered amendments to the constitution. 

There can be no doubt in anyone's mind that the ANC is not in favour of any solution within the constitutional framework and will act with more irrational aggression after yesterday's humiliation. We must have hope to work tirelessly on a solution to the current land issue, but to have hope also requires a positive attitude! The Afrikanerbond has consistently supported initiatives for the establishment of property rights in South Africa and strives to promote such rights for all in South Africa. Many proposals from civil society have been made in the past to find solutions in creative ways.
